KURT M. RYLANDER

Mr. Rylander is an experienced trial atto
rney and a registered patent attorney. He handles all aspects of intellectual property representation. He prepares and prosecutes applications for patents, trademarks, and copyrights. His patent practice includes both domestic and international applications and prosecution. He also handles intellectual property suits in Federal courts, before the Board of Patent Appeals and Interferences, (BPAI), before the Trademark Trial and Appeal Board (TTAB), and before the U.S. Court of Appeals for the Federal Circuit. He has also argued before the Ninth Circuit. Mr. Rylander regularly appears in State and Federal courts, at the trial level, and at the appellate level.

Mr. Rylander is a native of the Pacific Northwest. He graduated from the University of Washington, and received his juris doctor with cum laude honors from Lewis and Clark Law School, where he was appointed to and served on law review (winning the law review writing contest). Mr. Rylander practiced law for a number of years in Washington DC, where he handled commercial, regulatory, constitutional, and intellectual property law suits against the Federal Government and private entities, including appearing on brief for amicus curiae to the U.S. Supreme Court in Adarand Constructors v. Pena, 515 U.S. 200 (1995).

He has tried numerous jury trials to verdict as lead trial attorney. He has been to court thousands of times. He has represented plaintiffs and defendants in cases for patent infringement, trademark infringement, copyright infringement, and unfair competition, as well as government contract cases and general litigation in Federal courts, among others. He has secured preliminary injunctions against patent and trademark infringement, trade secret misappropriation, and against hiring of key personnel pursuant to noncompetition and trade secret provisions. He recently secured a victory before the Federal Circuit for his client in the precedential patent suit, Campbell Pet Company v. Miale et al., _ F.3d _ (Fed. Cir. 2008).

He has prosecuted patent applications in the mechanical, chemical, material science, business, software, electrical circuit, and manufacturing arts, among others. He has conducted successful patent appeals before the BPAI. He is one of the few patent practitioners to handle a Section 146 civil action in District Court to review (and successfully reverse) a priority interference decision by the BPAI. He has prosecuted trademark applications and successfully handled trademark opposition proceedings before the TTAB.

He has spoken at the U.S. Capitol for the U.S. Hispanic Chamber of Commerce, re-broadcast on CSPAN, and conducted seminars for public and private entities. He has authored and co-authored numerous articles, which have been published by the New York University School of Law and the American Bar Association, among others. He has coached high school mock trial teams and served as a mock trial judge for high school competitions. He has conducted CLEs on government contracting, intellectual property, corporate record keeping, and ethical dilemmas. He is a regular guest lecturer at Washington State University on Negotiation and the Law. He served as Lawyer Representative to the Ninth Circuit from the Western District of Washington. He currently serves Trustee of the Clark County Bar Association, Chair of the Superior Court Bench/Bar Committee for Clark County, Washington, and he has been a past Chair of the CLE Committee for Clark County, Washington. Mr. Rylander is a member of Rotary and serves as Chair of the 2008 Festival of Trees Teddy Bear Carnival Committee.

Mr. Rylander has a black belt in ju jutsu, is a marathon runner and a triathlete.He recently completed the 2008 Timberline Marathon.
